Employees currently at or were previously employed by the Calmark Group – a marketing organization – could be in line to receive a check.
The company has been accused of violating the Illinois Biometric Information Privacy Act.
A lawsuit has accused the firm of collecting fingerprint data without consent.
Those who could benefit are staffers or former workers who used a finger-scanning machine between February 16, 2018, and June 7, 2019 and didn’t give written consent.
The Calmark Group has not admitted any wrongdoing.
Claimants will pocket up to $663 but have been told the payment could be greater or less depending on the number of applications.
The only way to receive a share of the settlement is to submit a form online.
Americans could mail their application form, but it is now too late.
But unlike other settlements, they don’t have to provide proof of purchase.
Sometimes claimants must show evidence of receipts or bank statements to prove their losses.
It remains unknown when the payments will be distributed.
Americans have been warned the checks will be void if they are not redeemed within a 90-day window.
What's a class-action settlement?
Class action lawsuits offer groups of people, or 'classes,' a way to band together in court.
These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.
When a suit becomes a class action, it extends to all “class members,” or people who may have similar complaints to those who filed the suit.
Companies often settle class actions – offering payment to class members who typically waive their right to pursue further legal action by accepting money.
These payout agreements frequently include statements by the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.
Pollution, discrimination, or false advertising are a few examples of what can land a class action on a company’s doorstep.
It is too late to object to the settlement as the deadline was February 28.
The approval hearing for the settlement took place on April 3.
The U.S. Sun reported that bosses at the life insurance company Ethos Technologies have agreed to resolve a dispute via a settlement worth $1 million.
It is linked to claims that customers’ data was compromised during a data breach between August and December 2022.
A lawsuit claimed that the breach could have been stopped if measures in place were strong enough.
Americans who think they may have been impacted have only weeks to apply for a share of the cash.
Claimants could pocket up to $5,200, according to the settlement.
The U.S. Sun also reported how former Capital One customers might be in line to benefit from a settlement – even if they do not bank with the chain anymore.
