In August 2022, Connexin became aware that a third party had successfully accessed one of the company’s servers, per the settlement notice sent to class members.
As a result, the personal information of patients and employees was compromised.
According to the class action lawsuit, the data breach compromised social security numbers, health insurance data, employment information, and other identification information.
Around three million individuals are believed to be impacted by this breach and Connexin started sending notices out in December 2022.
The health record software provider has since been accused of failing to protect personal information which has seen impacted individuals incur losses or other injury.
To bring an end to litigation and to resolve the claims in the lawsuit, Connexin Software has agreed to a $4 million settlement.
In doing so, the company has not admitted to any wrongdoing.
Under the terms of the agreement, class members have two options.
They can get three years of free identity theft and fraud monitoring as a result of having their data compromised.
Or, receive a one-time payout of up to $7,500 for the losses incurred by the data breach.
Those individuals who opt for the latter will have to prove the losses related to the breach or accept an alternative cash payment.
Accepted proof of loss includes receipts, invoices, bank statements, and credit reports.
There are three key dates that eligible class members need to be aware of.
Individuals will know if they are eligible as they will have received a notice from Connexin about the breach in December 2022.
Class members have until June 25 to exclude themselves or object to the preliminary settlement agreement.
Those who exclude themselves will retain their legal right to bring future claims against Connexin regarding the data breach.
What's a class-action settlement?
Class action lawsuits offer groups of people, or 'classes,' a way to band together in court.
These suits are often brought by one or a few people who allege a company or other entity has wronged a large group of people.
When a suit becomes a class action, it extends to all “class members,” or people who may have similar complaints to those who filed the suit.
Companies often settle class actions – offering payment to class members who typically waive their right to pursue further legal action by accepting money.
These payout agreements frequently include statements by the defendant denying wrongdoing. Companies tend to settle class actions to avoid the costs of further litigation.
Pollution, discrimination, or false advertising are a few examples of what can land a class action on a company’s doorstep.
Individuals who fail to do so will forfeit this right even if they take no action and do not file a claim form for this settlement.
On July 24 at 10 am the court will hold a final approval hearing for the settlement agreement to ensure that it is fair to all parties involved.
All claim forms must be submitted by July 25 which can be done on the settlement website.
Meanwhile, the deadline for a $385,200 privacy settlement payout is fast approaching.
