THE time to file a claim to score a one-time payment from a settlement is fast approaching.
Presbyterian Healthcare Services has reached a settlement agreement in a class action lawsuit to address allegations of inadequate patient protection following a 2019 data breach.

The settlement pertains to individuals who received notifications from Presbyterian Healthcare Services regarding the potential compromise of their information in a data breach uncovered in June 2019.
Plaintiffs involved in the class action lawsuit claim that hackers accessed their personal and health data during the 2019 breach.
They asserted that the breach could have been prevented had Presbyterian Healthcare Services implemented appropriate cybersecurity measures, according to Top Class Actions.
While Presbyterian Healthcare Services has not admitted any wrongdoing, they have agreed to an undisclosed payment to resolve the class action lawsuit.
As per the settlement terms, eligible class members can claim reimbursement for various data breach-related expenses, including communication charges, credit expenses, miscellaneous costs, and compensation for up to three hours of lost time at a rate of $15 per hour.
Those who incurred documented extraordinary expenses, such as fraud or identity theft, may be eligible for reimbursement of up to $5,000.
Class members can receive one year of free credit monitoring through Experian IdentityWorks.
This features comprehensive monitoring across three bureaus and $1 million in reimbursement insurance.
ELIGIBILITY AND AWARDS
Eligible individuals include those who were issued a data breach notification from Presbyterian Healthcare Services, indicating that their information might have been compromised in a data breach detected in June 2019.
Individuals will be eligible for payments of up to $5,750 if they show proof of any of the following:
Invoices
Receipts
Account statements
Travel documentation
Credit reports
You can file a claim at the settlement’s website.
YOUR RIGHTS IN MIND
You have rights and options in this lawsuit, per PHS Data Incident Settlement, including:
Doing nothing
While you will be part of the Settlement Class, you will not receive any benefits.
However, you will be obligated to adhere to the Court’s judgment of dismissal and release any claims against PHS concerning the Data Incident.
This has no deadline.
Submitting a claim
Members of the Settlement Class have the option to submit a Settlement Claim in order to receive settlement benefits.
To receive any benefits from this Settlement, you must submit a Valid Claim to the Claims Administrator.
Deadline to submit a claim comes on May 16, 2024.
Opting out
Should you opt to exclude yourself from the Settlement, you will not be part of it.
Consequently, you will not receive any benefits, nor will you waive any claims you may have against PHS/Released Entities concerning the Data Incident.
Deadline to object passed on April 16, 2024.
Objecting
If you intend to raise objections to the Settlement, you must submit a written notice of your objection to the Clerk of the Court in a timely manner.
You must provide a copy of your objection to the attorneys representing the Parties. It’s important to note that if you choose to exclude yourself from the Settlement, you forfeit the ability to file an objection.
Settlement Class Members who fail to timely submit objections in this manner will be deemed to have waived all objections and will not have the opportunity to appeal the approval of the Settlement.
In the event that you file an objection and wish for it to be considered, you must also attend the Final Fairness Hearing, either in person or through legal representation. During this hearing, you must demonstrate reasons why the proposed Settlement should not be approved as fair, reasonable, and adequate.
