As shared by The U.S. Sun, Josh recently filed a motion for a new trial to have his guilty conviction thrown out. Representing himself, he claimed that he was “deprived of a fair trial.” In particular, Josh made claims of “uncorroborated and prejudicial testimony” concerning Bobye Holt.
Holt, who had once been a friend of the Duggar family, had provided testimony at his original trial. As the publication noted, she testified that she had planned for Josh to marry her eldest daughter. However, this idea was dropped when she learned of reports of Josh having molested five underage females when he was 12 to 16 years old. A police report concerning these claims was published by In Touch in 2006.
At the 2021 trial, Holt shared, “He told us so our oldest daughter would know why the relationship had to end. Josh went to a facility for troubled youth.” At the time, she cried in the courtroom that she “still loves” Josh despite his behavior, adding, “being here is miserable.”
The Motion Included Other Reasons Josh Felt The Verdict Should Be Thrown Out
However, Josh took issue with the testimony in the recent motion. As court papers read, “Despite multiple objections from defense counsel, the trial court allowed Holt to testify about an alleged confession of uncharged criminal conduct by the defendant dating back to 2003.”
The papers continued, “Holt refused to speak to defense counsel prior to trial, and the prosecution failed to disclose key facts undermining her credibility.” It was alleged that Holt’s motivations were “far from neutral” and she “willingly and fully cooperated with the prosecution.”

It was also alleged that Holt has a “deep-rooted desire to destroy the Duggar family,” noting “anti-Duggar” sentiments shared on social media. Josh also shared a possible motive.
As the papers claimed, “In many ways, she resembled a bitter ex who hated Joshua since she couldn’t have him for her own daughter. She also participated in paid, anti-Duggar media productions, including an Amazon docuseries, appearing alongside her husband, which directly defamed and disparaged the Duggar family. This pattern of hostility and bias was not disclosed to the jury.” It is believed this was referencing Holt appearing on the docuseries, Shiny Happy People: Duggar Family Secrets, in 2003.
The motion also reportedly cited other reasons Josh feels the guilty verdict should be thrown out. This included “false testimony by a government agent” and evidence of an “alternative perpetrator” allegedly being excluded at trial.
