Oro Valley Man Indicted for Allegedly Assaulting Border Patrol Agent with Firearm in Nogales
An Oro Valley man is facing serious time after being slapped with federal charges for allegedly taking a potshot at a Border Patrol agent. The U.S. Attorney's Office in Arizona said Erik Alberto Beal, 26, was hit with a two-count indictment for assaulting a federal officer with a firearm and for brandishing that weapon during the heat of a violent crime.
According to a May 1 press release from the U.S. Attorney’s Office, the incident unfolded back on April 11, when Border Patrol agents were patrolling near the international line in Nogales, Arizona chasing a suspect who hopped the border fence and fled onto nearby private property, Beal reportedly came out of his house brandishing a Sig Sauer .45 caliber pistol and aimed it squarely at one of the agents before he was ultimately tackled and cuffed.
If Beal's convicted of the assault charge, he could be staring down the barrel of a 20-year prison sentence, plus a fine of up to $250,000. The stakes are even higher for the firearm charge, with a sentence that could range from a mandatory minimum of seven years, all the way to a life term behind bars, with another possible fine of $250,000.
The FBI and CBP’s Office of Professional Responsibility are digging into the details of the case, with Assistant U.S. Attorney Serra M. Tsethlikai spearheading the prosecution.
